It has been reported that SpaceX fired eight employees for publicly criticising the company’s CEO, Elon Musk, in a manner that is being investigated to see whether or not it was legal.

A report from a labour agency in the United States stated that in 2022, the employees had composed a letter to the company’s upper management addressing workplace concerns. The letter, as reported by Reuters, labelled the CEO an “embarrassment and distraction.” The BBC requested SpaceX’s opinion regarding the subject.

A regional official at the National Labour Relations Board (NLRB) lodged the complaint, which alleged that SpaceX had contravened federal labour laws permitting employees to advocate collectively for improved working conditions. Additionally, the complaint alleges that SpaceX interrogated individuals who participated in the open letter before terminating them.

Lawyers representing Deborah Lawrence, one of the former employees, have apparently accused SpaceX of fostering a “toxic culture” that tolerates harassment.

Ms. Lawrence stated in a Reuters-obtained statement that they wrote the open letter to the leadership not to cause harm, but because they genuinely cared about the mission and the people working alongside them.

The NLRB’s general counsel functions like a prosecutor, bringing cases before the board, which consists of five members appointed by the organization’s president.

If SpaceX doesn’t settle, the case will proceed to an administrative judge for a hearing scheduled for March 5th. Parties can appeal the judge’s decision to the board and then to a federal appeals court.

Should the NLRB determine that the firings breached labour laws, they could mandate reinstating the workers and providing back pay.

Previously, Mr. Musk’s firms were accused of violating employee rights.

The NLRB charged X (previously Twitter) with removing an employee in October, reportedly for posts that questioned the company’s return-to-work policy. X denied having done anything inappropriate.

Tesla, an automobile company, has faced many NLRB allegations, including claims of racial discrimination in its manufacturing. Tesla has said that it has a zero-tolerance policy for discrimination. The US Department of Justice accused SpaceX in August, claiming discriminatory employment practices against refugees and asylum seekers. Mr. Elon Musk reacted on X, claiming that SpaceX follows US law, which requires a green card for work since rockets are considered as sophisticated technological weapons
